Shipping Details

Shipping Policy

FREE shipping on all US orders (lower 48). Expedited shipping options are available during checkout. Orders over $800 are shipped with a signature required. Orders that require expedited shipping must be placed before 1 p.m. MST to arrive within the service window. Any Express orders purchased after 1p.m. will be shipped the following business day and are not guaranteed to arrive within the express window. 

US orders typically ship from one of our four North American fulfillment centers by Fedex Ground. In severe back order situations, we may ship by air direct from our manufacturing facilities. Tracking information will be emailed upon shipment of all orders.

Discounted International Shipping. Discounted rates will automatically be calculated at checkout. 

International shipping originates from our overseas warehouse. 

PLEASE NOTE: International shipping does not include import taxes or duties to your country. Additional taxes and customs clearance fees will be payable upon delivery. Please allow around 2-5 days for our overseas team to ship your order. Once the item is shipped, you will receive a tracking number. If you have not received a tracking number this means your order is in the queue and will be shipped in the order it was received. 

Any shipment within the USA that was shipped correctly but is subsequently refused by the recipient, unable to be delivered with the customer supplied address or returned to our warehouse will incur a flat $35 fee per item for shipping/warehousing/receiving charges. Any international returned shipment will incur a $50 fee per item and the shipping fees are non-refundable. 

Buyer has ten (10) days after delivery to report the receipt of a damaged item. Damages during shipping are rare, but they do happen.

Please inspect your light and report any issues to us within this 10 day grace period. Mito Red Light will not be responsible for damages reported to us after this 10 day period. 

Time in Transit

All orders are shipped in the order in which they are received.  Our fulfillment centers fulfill orders Monday - Friday. The time in transit depends on your distance from the distribution center which your order is shipped (typically 1-7 business days).

All international orders ship from our overseas facility and are shipped in the order in which they are received.  International shipment times vary but are typically 4-10 days.

PLEASE NOTE: International shipping does not include import taxes or duties to your country. Additional taxes and customs clearance fees will be payable upon delivery. Warranty valid only to original purchaser if item purchased directly from www.mitoredlight.com or authorized re-seller and is non-transferable. The warranty period starts the date the original purchased unit is delivered. 

What does this warranty cover?

The warranty covers any defects in material or workmanship under normal use during the warranty period. During the warranty period, Mito Red will replace, at no charge, products that prove defective because of improper material or workmanship, under normal use and maintenance.

What will we do to correct the problems?

Mito Red will replace the products at no charge. For the first 180 days, Mito Red will be responsible for all shipping costs related to your request. After the first 180 days, buyer will be responsible for product shipping charges and related coverage while in transit to Mito Red.  Please retain the tracking information for proof of delivery to us.

What does the warranty not cover?

The warranty does not cover any problem that is caused by damage resulting from negligence, improper maintenance, or modification; the warranty does not cover theft or loss of the product.

What do you have to do?

To obtain warranty service, you must first contact us at info@mitoredlight.com to determine the problem and the most appropriate solution for you.  You may be asked to provide proof of any defects, and therefore you should maintain photos and videos of any alleged defects.

Returns

Mito Red offers a full 60-day trial of all products. The 60-day trial period commences upon  customer’s receipt of the product. Return shipping is paid by you. We require that returns be sent back in the original packaging to prevent damage in transit. You shall retain the tracking information to provide proof of delivery to Mito Red. Mito Red is not liable for lost or damaged return shipments and we reserve the right to charge for any damages you caused to the product.

Refunds for customers choosing to return during the 60-day trial period are 100% of product cost – any elective expedited shipping costs and international shipping costs are non-refundable.

Returns must note your full name and order number. Returns must be postmarked before the end of the 60-day trial period. Returns after the 60-day trial period will not be accepted.

If the returned product is damaged in any way or returned in an un-sellable condition. The shipment will be refused and returned to the sender.

Damages

Buyer has ten (10) days after delivery to report receipt of a damaged item. Please inspect your product carefully and report any damages within the 10-day period. Mito Red is not responsible for damages reported after the 10-day period. We will require photo and video proof of receiving a product that is damaged so that we can address the issue with the manufacturer or shipping company.

Refunds

Once your return is received and inspected, you will be sent an email to notify you that the item has been received. If the refund is approved then the refund will be processed, and a credit will automatically be applied to your credit card or original method of payment. Once processed, please allow up to 5 business days for the credit to appear on your statement. 

Exchanges

Items will be replaced if they are defective or damaged, subject to the damages proof requirements, meaning, we will require photo and video proof of receiving a product that is damaged. If you need to exchange the item for the same item, you must send an email to info@mitoredlight.com requesting the exchange.

IN NO EVENT WILL MITO RED LIGHT’S TOTAL LIABILITY ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR FROM THE USE OF OR INABILITY TO USE THE SERVICES OR PRODUCTS EXCEED THE AMOUNTS YOU HAVE PAID TO MITO RED LIGHT FOR USE OF THE SERVICES OR PRODUCTS GIVING RISE TO THE LIABILITY DURING THE TWELVE MONTHS IMMEDIATELY PRECEDING THE EVENTS GIVING RISE TO THE LIABILITY.

Because some states or jurisdictions do not allow the exclusion or the limitation of liability for consequential or incidental damages, in such states or jurisdictions, our liability shall be limited to the maximum extent permitted by law.

The Warranties above are valid only to original purchaser if item purchased directly from www.mitoredlight.com or authorized re-seller and is non-transferable. The warranty period starts the date the original purchased unit is delivered. 

The warranty covers any defects in material or workmanship under normal use during the warranty period. During the warranty period, Mito Red will replace, at no charge, products that prove defective because of improper material or workmanship, under normal use and maintenance.

Mito Red will replace the products at no charge. For the first 180 days, Mito Red will be responsible for all shipping costs related to your request. After the first 180 days, buyer will be responsible for product shipping charges and related coverage while in transit to Mito Red.  Please retain the tracking information for proof of delivery to us.

The warranty does not cover any problem that is caused by damage resulting from your negligence, improper maintenance, improper use, experimental use, or modifications; the warranty does not cover theft or loss of the product.

To obtain warranty service, you must first contact us at info@mitoredlight.com to determine the problem and the most appropriate solution for you. You may be asked to provide proof of any defects, and therefore you should maintain photos and videos of any alleged defects.

You and Mito Red Light agree that any dispute, claim or controversy arising out of or relating to these Terms or the breach, termination, enforcement, interpretation or validity thereof or the use of the Services or Content (collectively, “Disputes”) will be resolved by binding arbitration, except that each party retains the right: (i) to bring an individual action in small claims court and (ii) to seek injunctive or other equitable relief in a court of competent jurisdiction to prevent the actual or threatened infringement, misappropriation or violation of the Company’s copyrights, trademarks, trade secrets, patents or other intellectual property rights (the action described in the foregoing clause (ii), an “IP Protection Action”). 

Without limiting the preceding sentence, you will also have the right to litigate any other Dispute in court, if you provide Mito Red Light with written notice of your desire to OPT OUT of this arbitration agreement by regular mail at Mito Red Light, Inc., Attn:  General Counsel, 9319 N 94th Way Ste 400, Scottsdale, AZ 85260 within thirty (30) days following the date you first access the Services (such notice, an “Arbitration Opt-out Notice”). If you don’t provide Mito Red Light with an Arbitration Opt-out Notice within the thirty (30) day period, you will be deemed to have knowingly and intentionally waived your right to litigate any Dispute except as expressly set forth in clauses (i) and (ii) above.

The exclusive jurisdiction and venue of any IP Protection Action or, if you timely provide Mito Red Light with an Arbitration Opt-out Notice, will be the state and federal courts located in the Arizona and each of the parties hereto waives any objection to jurisdiction and venue in such courts. Unless you timely provide Mito Red Light with an Arbitration Opt-out Notice, you acknowledge and agree that you are waiving the right to a trial by jury or to participate as a plaintiff or class member in any purported class action or representative proceeding.

Further, unless both you and Mito Red Light otherwise agree in writing, the arbitrator shall not consolidate more than one person's claims, and shall not otherwise preside over any form of any class or representative proceeding. If this specific paragraph regarding class claims is held unenforceable, then the remaining “Dispute Resolution” terms in this Section will remain valid and enforceable to the greatest extent possible. . Except as provided in the preceding sentence, this “Dispute Resolution” section will survive any termination of these Terms.

Arbitration Rules

The arbitration will be administered by the American Arbitration Association (“AAA”) in accordance with the Commercial Arbitration Rules and the Supplementary Procedures for Consumer Related Disputes (the “AAA Rules”) then in effect, except as modified by this “Dispute Resolution” section. (The AAA Rules are available at www.adr.org/.) The Federal Arbitration Act will govern the interpretation and enforcement of this Section.

Arbitration Process

A party who desires to initiate arbitration must provide the other party with a written Demand for Arbitration as specified in the AAA Rules. (The AAA provides a general Demand for Arbitration ). The arbitrator will be either a retired judge or an attorney licensed to practice law and will be selected by the parties from the AAA’s roster of arbitrators. If the parties are unable to agree upon an arbitrator within seven (7) days of delivery of the Demand for Arbitration, then the AAA will appoint the arbitrator in accordance with the AAA Rules.

Arbitration Location and Procedure

The arbitration shall be conducted inPhoenix, Arizona by a single arbitrator. If your claim does not exceed $10,000, then the arbitration will be conducted solely on the basis of the documents that you and Mito Red Light submit to the arbitrator, unless either party requests a hearing or the arbitrator determines that a hearing is necessary. If your claim exceeds $10,000, your right to a hearing will be determined by the AAA Rules. Subject to the AAA Rules, the arbitrator will have the discretion to direct a reasonable exchange of information by the parties, consistent with the expedited nature of the arbitration.

Arbitrator’s Decision

The arbitrator will render an award within the time frame specified in the AAA Rules. The arbitrator’s decision will include the essential findings and conclusions upon which the arbitrator based the award. Judgment on the arbitration award may be entered in any court having jurisdiction thereof. The arbitrator’s award of damages must be consistent with the terms of the “Limitation of Liability” section above as to the types and amounts of damages for which a party may be held liable. The arbitrator may award declaratory or injunctive relief only in favor of the claimant and only to the extent necessary to provide relief warranted by the claimant’s individual claim. Mito Red Light reserves its right to recover, attorneys’ fees and expenses if it prevails in arbitration and in particular if the dispute could have been resolved pre-arbitration or is otherwise frivolous.

Fees

You will be responsible to pay any AAA filing, administrative and arbitrator fees as set forth in the AAA Rules.

The Mito Red Light App does not use any data for tracking purposes.

We do not use email including hashed emails for tracking purposes. We use email including hashed emails to enable the app to function.  Usage may include authenticate the user, enable features, prevent fraud,
and improve scalability and performance.


We use an internal user Id to enable the app to function.  Usage may include authenticate the user, enable features, prevent fraud, implement security measures, ensure server up-time, minimize app crashes, and improve scalability and performance.


We use analytics data to evaluate user behavior, including to understand the effectiveness of existing product features, plan new features, identify and minimize app crashes, or measure audience size or characteristics.

Some of the analytics demographics data that we collect in aggregate is optional.  We ask for age but you may leave it blank.  For gender, you have the "Other" option. You may choose to tell us your pigment skin type.  All the demographics data is used in aggregate to help us understand the effectiveness of existing product features, plan new features, or measure audience size or characteristics.

We save analytics information on product interaction such as app sessions and session benefits. We use product interaction analytics to evaluate user behavior, including to understand the effectiveness of existing product features, to understand product therapeutic benefits, plan new features, or measure audience size or characteristics.
